Jury Duty & Service

 

A note from the presiding judge:

You have been called for jury duty and should consider it an honor. I know you will honor the system and I look forward to seeing you on your day of calling.

Employees excused from employment; compensation; postponement of service.
Section 12-16-8, Code of Alabama

(a) Upon receiving a summons to report for jury duty, any employee shall on the next day he is engaged in his employment exhibit the summons to his immediate superior, and the employee shall thereupon be excused from his employment for the day or days required of him in serving as a juror in any court created by the constitutions of the United States or of the State of Alabama or the laws of the United States or of the State of Alabama.

(b) An employee my not be required or requested to use annual, vacation, unpaid leave, or sick leave for time spent responding to a summons for jury duty, time spent participating in the jury selection process, or for time spent actually serving on a jury. Nothing in this subsection shall be construed to require an employer to provide annual, vacation, or sick leave to employees who otherwise are not entitled to the benefits under policies of the employer.

(c) Notwithstanding the excused absence provided in subsection (a) , any fill-time employee shall be entitled to his or her usual compensation received from such employment.

(d) Notwithstanding subsection (a), a court shall automatically postpone and reschedule the service of a summoned juror who is an employee of and employer with five or fewer full-time employees, or their equivalent, if another employee of that employer also has been summoned to appear during the same period. A postponement pursuant to this section shall not affect an individual's right to one automatic postponement under Section 12-16-63.1.

Practical Considerations

 

Arrive early to all court proceedings.

Be prepared for extended waiting periods.

Layer clothing and bring a sweater to the courtroom.

Do not bring children to jury duty.

Jury FAQ’s

 

What is jury duty voir dire?

The purpose of voir dire is to exclude from the jury people who may not be able to decide the case fairly. Members of the panel who know any person involved in the case, who have information about the case, or who may have strong prejudices about the people or issues involved in the case, typically will be excused by the judge.

What do I do if my jury duty interferes with work?

When you are summoned for jury duty, you must immediately notify your employer in order to be excused from work. If you are released from jury duty during the week, you must return to work. When you are discharged from jury duty, you will be given a Certificate of Jury Service to take to your employer as proof of your jury service. Your employer is required by law (Per Section 12-16-8(c) Code of Alabama) to pay you your normal salary if you are a full-time employee or work a full-time schedule on a regular basis. Employers are not required to pay part-time employees their normal salary by law. The Jury Act forbids any employer from firing, intimidating, or coercing any permanent employee because of their federal jury service.
