Criminal Court

The circuit court shall have exclusive original jurisdiction of all felony prosecutions and of misdemeanor or ordinance violations which are lesser included offenses within a felony charge or which arise from the same incident as a felony charge; except, that the district court shall have concurrent jurisdiction with the circuit court to receive pleas of guilty in felony cases not punishable by sentence of death. The circuit court may, on conviction of a defendant, upon a showing of inability to make immediate payment of fine and costs, continue the case from time to time to permit the fine and costs to be paid.

Misdemeanor

The District Attorney's Pre-Trial Diversion (PTD) Program diverts certain first-time, nonviolent defendants from the traditional court system into a highly supervised and individualized restorative program. If you have been charged with a misdemeanor, you may qualify for the State of Alabama Pre-Trial Diversion Program. Felony

The Alabama Criminal Code has four classes of felony offenses: Class A, B, C, and D. Alabama law sets out a standard range of prison sentences that judges may impose for each class of felony. If you're convicted of, or plead guilty to, a felony, the sentence you receive will depend on the classification of the crime, as well as the circumstances and other factors such as your previous criminal history.
